T&#253;m pod veden&#237;m profesora Juliana Nyarka srovnal odpov&#283;di AI s odpov&#283;&#271;mi profesor&#367; pr&#225;va. AI vyhr&#225;la zhruba ve 3 ze 4 p&#345;&#237;pad&#367;.</p><p>To d&#367;le&#382;it&#233; je co se m&#283;&#345;ilo a kde je hodnota zku&#353;en&#233;ho profesion&#225;la. </p><h2>Co se testovalo</h2><p>N&#225;zev studie je &#8220;Law Professors Prefer AI Over Peer Answers&#8221;. Zapojilo se 16 profesor&#367; ze 14 americk&#253;ch pr&#225;vnick&#253;ch fakult.</p><p>Postup byl jednoduch&#253;. Profeso&#345;i p&#345;ipravili 40 reprezentativn&#237;ch studentsk&#253;ch dotaz&#367; z kontrakta&#269;n&#237;ho pr&#225;va, tedy ty ot&#225;zky, co padaj&#237; po p&#345;edn&#225;&#353;ce nebo na konzultac&#237;ch. Ka&#382;d&#253; napsal svou odpov&#283;&#271;. Na stejn&#233; ot&#225;zky odpov&#283;d&#283;la i AI (Gemini 2.5 Pro a NotebookLM).</p><p>Pak v&#353;ichni hodnotili anonymizovan&#233; dvojice odpov&#283;d&#237;, bez znalosti autora. Vyb&#237;rali jen tu, kterou by rad&#283;ji dali studentovi. T&#233;m&#283;&#345; 3 000 porovn&#225;n&#237;.</p><p>AI zv&#237;t&#283;zila p&#345;ibli&#382;n&#283; ve 3 ze 4 p&#345;&#237;pad&#367;. To u&#382; je rozd&#237;l, kter&#253; nevysv&#283;tl&#237;te n&#225;hodou ani drobnou stylistickou preferenc&#237;. Auto&#345;i sami p&#345;izn&#225;vaj&#237;, &#382;e je v&#253;sledky p&#345;ekvapily. Studie ale nem&#283;&#345;ila pr&#225;vn&#237; re&#353;er&#353;i. Ani drafting smluv. Ani strategii sporu.</p><p>M&#283;&#345;ila <strong>schopnost srozumiteln&#283; vysv&#283;tlit probl&#233;m za&#269;&#225;te&#269;n&#237;kovi.</strong></p><p>Profesory na AI odpov&#283;d&#237;ch zaujala jasnost, struktura a schopnost dov&#233;st studenta k pochopen&#237;. To v&#353;echno jsou dovednosti u&#269;itele, a p&#345;esn&#283; v nich dne&#353;n&#237; modely vynikaj&#237;. Hloubka pr&#225;vn&#237; anal&#253;zy p&#345;itom rozhodovala p&#345;ekvapiv&#283; m&#225;lo.</p><p>Por&#225;&#382;ka tedy p&#345;i&#353;la v pedagogice, zat&#237;mco pr&#225;vn&#237; hloubka z&#367;stala stranou. A to je podle m&#283; nejd&#367;le&#382;it&#283;j&#353;&#237; zji&#353;t&#283;n&#237; cel&#233; studie.</p><h2>&#268;&#237;slo, kter&#233; zar&#225;&#382;&#237; v&#237;c ne&#382; to prvn&#237;</h2><p>AI odpov&#283;di byly ozna&#269;eny za pedagogicky &#353;kodliv&#233; v 3,5 % p&#345;&#237;pad&#367;. Odpov&#283;di profesor&#367; ve 12 %. Trojn&#225;sobek.</p><p>Pro&#269;? AI dr&#382;&#237; linku. Neodb&#237;h&#225;, neimprovizuje, neza&#269;ne odbo&#269;kou o tom, jak to bylo za jej&#237;ch studi&#237;. Je konzistentn&#237; a systematicky vysv&#283;tluje kroky.</p><p>Zku&#353;en&#253; expert &#269;asto trp&#237; opa&#269;nou &#8220;nemoc&#237;&#8221;. V&#237; toho tolik, &#382;e zapomn&#283;l, jak uva&#382;uje n&#283;kdo, kdo to sly&#353;&#237; poprv&#233;. &#344;&#237;k&#225; se tomu proklet&#237; znalosti a maj&#237; ho intern&#237; pr&#225;vn&#237;ci, advok&#225;ti stejn&#283; jako na profeso&#345;i ze Stanfordu.</p><h2>Koho AI vlastn&#283; ohro&#382;uje</h2><p>Studie uk&#225;zala je&#353;t&#283; jednu v&#283;c, kter&#225; je vid&#283;t v praxi po&#345;&#225;d &#269;ast&#283;ji. Nejlep&#353;&#237; modely byly srovnateln&#233; s nejlep&#353;&#237;mi lidsk&#253;mi u&#269;iteli ve vzorku. &#352;pi&#269;ka zat&#237;m dr&#382;&#237;.</p><p>Pod &#353;pi&#269;kou to vypad&#225; jinak. Pokud jste nejlep&#353;&#237; vysv&#283;tluj&#237;c&#237; ve sv&#233;m oboru, AI v&#225;s zat&#237;m netr&#225;p&#237;. Pokud jste pr&#367;m&#283;rn&#253; (a statisticky vzato v&#283;t&#353;ina z n&#225;s v n&#283;&#269;em pr&#367;m&#283;rn&#225; je), AI pr&#225;v&#283; te&#271; d&#283;l&#225; va&#353;i pr&#225;ci levn&#283;ji, rychleji a v noci.</p><p>AI je tady hlavn&#237;m konkurentem pro zku&#353;en&#233;, ale pr&#367;m&#283;rn&#233; experty, ne pro juniory  na za&#269;&#225;tku kari&#233;ry. To je ekonomicky mnohem z&#225;sadn&#283;j&#353;&#237; moment, ne&#382; kolik se o n&#283;m mluv&#237;.</p><h2>Kam se hodnota experta posouv&#225;</h2><p>Rutinn&#237; vysv&#283;tlov&#225;n&#237; zlev&#328;uje t&#233;m&#283;&#345; na nulu. Vz&#225;cnou se st&#225;v&#225; jin&#225; sada schopnost&#237;.</p><p><strong>&#218;sudek. Kontext, kter&#253; nen&#237; v &#382;&#225;dn&#233;m datasetu, proto&#382;e &#382;ije jen v t&#233;hle konkr&#233;tn&#237; firm&#283; a t&#233;hle konkr&#233;tn&#237; situaci. Schopnost polo&#382;it spr&#225;vnou ot&#225;zku d&#345;&#237;v, ne&#382; za&#269;nete hledat odpov&#283;&#271;. Pr&#225;ce s nejistotou. A ochota &#345;&#237;ct &#8220;tohle bych ud&#283;lal takhle&#8221; a podepsat se pod to.</strong></p><p>V praxi to vid&#237;m &#269;&#237;m d&#225;l &#269;ast&#283;ji. Klient si prvn&#237; vysv&#283;tlen&#237; vezme od AI. Za pr&#225;vn&#237;kem nebo konzultantem p&#345;ijde ve chv&#237;li, kdy se pot&#345;ebuje rozhodnout, vyhodnotit riziko, zvolit strategii a p&#345;edat odpov&#283;dnost na n&#283;koho, kdo ji unese.</p><p>To je dobr&#225; zpr&#225;va, pokud jste tu hodnotu budovali. A varov&#225;n&#237;, pokud jste 20 let prod&#225;vali hlavn&#283; to, &#382;e um&#237;te v&#283;ci hezky vysv&#283;tlit.</p><h2>Co si z toho odn&#233;st</h2><p>AI ve studii porazila profesory v oblasti, kterou jsme dlouho pova&#382;ovali za v&#253;sostn&#283; lidskou: ve vysv&#283;tlov&#225;n&#237;, u&#269;en&#237; a veden&#237; k pochopen&#237;.</p><p>Pro ka&#382;d&#233;ho, kdo rad&#237;, zastupuje nebo vede, je v tom jeden praktick&#253; sign&#225;l. <strong>Hodnota zku&#353;en&#233;ho profesion&#225;la se p&#345;esouv&#225; od dod&#225;v&#225;n&#237; odpov&#283;d&#237; k dod&#225;v&#225;n&#237; &#250;sudku.</strong></p><p>Zkuste si tenhle t&#253;den u jedn&#233; sch&#367;zky polo&#382;it ot&#225;zku: za co mi tenhle &#269;lov&#283;k doopravdy plat&#237;? [1] Od t&#233; doby ho prov&#283;&#345;ili ve Spojen&#253;ch st&#225;tech, It&#225;lii, &#344;ecku, mezi l&#233;ka&#345;i, u&#269;iteli i studenty. [2] [3] Poka&#382;d&#233; fungoval.</p><p>Je spolehliv&#253; v technick&#233;m smyslu. Studie opakovan&#283; potvrzuj&#237; vysokou vnit&#345;n&#237; konzistenci (hodnoty Cronbachovy alfy mezi 0.90 a 0.96), co&#382; laicky &#345;e&#269;eno znamen&#225;, &#382;e test m&#283;&#345;&#237; to, co slibuje, a m&#283;&#345;&#237; to stabiln&#283;. CBI je dobr&#253; n&#225;stroj, ale nen&#237; to l&#233;ka&#345;sk&#225; diagn&#243;za. Berte ho jako odrazov&#253; m&#367;stek, ne jako rozsudek. Kdy&#382; v&#225;m vyjdou vysok&#225; sk&#243;re nap&#345;&#237;&#269; v&#353;emi t&#345;emi oblastmi, je to sign&#225;l, &#382;e stoj&#237; za to mluvit s n&#283;k&#253;m, kdo v&#225;m pom&#367;&#382;e (l&#233;ka&#345;, terapeut, n&#283;kdo, komu v&#283;&#345;&#237;te). Test v&#225;m uk&#225;&#382;e sm&#283;r. Cestu po n&#283;m si projdete s odbornou oporou.</p><p>Je&#353;t&#283; jedna pozn&#225;mka k interpretaci. Nech&#225;pav&#253; pohled. Pauza. Aha! Co kdy&#382; probl&#233;m nen&#237; byznys model, ale zp&#367;sob, jak&#253;m m&#225; sestaven&#233; a nacen&#283;n&#233; slu&#382;by. N&#283;co, co &#250;pln&#283; p&#345;ehl&#237;&#382;ela.</p><p>&#344;e&#353;en&#237; se objevilo proto, &#382;e jsme p&#345;em&#253;&#353;leli<strong> </strong><em><strong>spole&#269;n&#283;</strong></em><strong>.</strong></p><p><strong>Pro&#269; se tomu br&#225;n&#237;me</strong></p><p>&#344;ada l&#237;dr&#367; se tomu br&#225;n&#237;. Maj&#237; pocit, &#382;e by to m&#283;li "zvl&#225;dnout sami".
